OVERVIEW

Welcome to Pawrello.

The terms “Pawrello”, “we”, “us” and “our” refer to Pawrello.

Pawrello operates this online store and website, including all related information, content, features, tools, products and services, to provide customers with personalised pet products and gifts.

Pawrello operates using a print-on-demand model. This means that products may be designed, processed, printed, engraved, manufactured, packaged or shipped by independent production and fulfilment providers.

Our online store is powered by Shopify, which enables us to provide our products and services to you.

These Terms of Service, together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies referenced on our website, describe your rights and responsibilities when using our website or purchasing from Pawrello.

Please read these Terms carefully.

By visiting, browsing, interacting with or purchasing through our website, you agree to be bound by these Terms of Service and our applicable store policies.

If you do not agree to these Terms, you must not use our website or purchase our products.

Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or protection that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.


SECTION 1 – ELIGIBILITY, ACCESS AND ACCOUNTS

You must be at least 18 years old to place an order with Pawrello.

If you are under 18, you may use our website only with the involvement and permission of a parent or legal guardian. The parent or legal guardian must place or approve the order and accepts responsibility for the transaction.

To browse our website, create an account or place an order, you may be asked to provide information such as:

  • your name;
  • email address;
  • telephone number;
  • billing details;
  • delivery details;
  • payment information;
  • uploaded photographs; and
  • product customisation information.

You agree that all information you provide is accurate, current and complete and that you are authorised to provide it.

You are responsible for:

  • maintaining the security of your account credentials;
  • keeping your account information current;
  • preventing unauthorised access to your account; and
  • activity conducted through your account.

You must notify us promptly if you believe your account or password has been accessed or used without authorisation.

You must not sell, assign, transfer or license your account to another person.

We may suspend or restrict an account where reasonably necessary to:

  • protect customers or Pawrello;
  • investigate suspected fraud;
  • prevent unlawful activity;
  • address a breach of these Terms; or
  • comply with a legal requirement.

SECTION 2 – OUR PRODUCTS

Pawrello sells personalised pet products and gifts, which may include custom artwork, pillows, apparel, pet tags and other personalised items.

We make reasonable efforts to display and describe products accurately.

However, the appearance of a product may vary slightly because of:

  • screen settings;
  • device displays;
  • lighting;
  • image resolution;
  • printing methods;
  • fabric or material differences;
  • manufacturing tolerances;
  • product size;
  • cropping;
  • engraving methods; and
  • the personalised nature of the design.

Colours displayed on a screen may not exactly match the colours of a physical printed product.

Product images, lifestyle images and digital mock-ups may be illustrative. Props, frames, furniture, pets or accessories shown in product photographs are not included unless stated in the product description.

Personalised artwork may involve artistic interpretation, including changes to:

  • backgrounds;
  • image positioning;
  • cropping;
  • colour balance;
  • lighting;
  • shadows;
  • fonts;
  • layout; and
  • minor visual details.

These reasonable variations do not affect any rights you may have where a product fails to comply with the Australian Consumer Law.

Product descriptions, designs, availability and specifications may be updated from time to time.

We may discontinue a product or limit product quantities or availability where reasonably necessary.


SECTION 3 – CUSTOMER PHOTOGRAPHS AND CONTENT

When purchasing a personalised product, you may upload or provide:

  • pet photographs;
  • photographs containing people;
  • names;
  • dates;
  • messages;
  • engraving details;
  • artwork instructions;
  • logos;
  • designs; or
  • other customisation content.

This material is referred to in these Terms as “Customer Content”.

You retain ownership of any intellectual property rights you hold in your Customer Content.

By submitting Customer Content, you grant Pawrello a non-exclusive, worldwide, royalty-free licence to:

  • receive;
  • store;
  • copy;
  • crop;
  • resize;
  • edit;
  • enhance;
  • remove backgrounds from;
  • convert;
  • reproduce;
  • transmit;
  • process; and
  • provide the Customer Content to our production partners.

This licence is limited to what is reasonably necessary to:

  • prepare your design;
  • create artwork or a product mock-up;
  • obtain your approval;
  • manufacture or print your product;
  • conduct quality-control checks;
  • package and deliver the order;
  • provide customer support;
  • investigate a complaint;
  • arrange a replacement or reprint; and
  • comply with legal or recordkeeping obligations.

Submitting Customer Content for an order does not give Pawrello permission to use it in advertising, social media or promotional materials.

We will obtain separate permission before using a privately uploaded customer photograph for marketing.

You represent and warrant that:

  • you own the Customer Content or have permission to use it;
  • you have authority to provide it to us;
  • our processing and reproduction of it will not infringe another person’s rights;
  • any identifiable person shown has consented where consent is required;
  • you have appropriate permission before uploading an identifiable image of a child;
  • the Customer Content is not unlawful, threatening, abusive, discriminatory, defamatory, obscene or misleading; and
  • the Customer Content does not contain malicious code or material intended to interfere with our systems.

You must not upload confidential documents, payment information, identification documents or unnecessary sensitive information.

We may refuse or cancel a personalised order if the supplied content:

  • appears unlawful;
  • infringes or may infringe intellectual property rights;
  • contains hateful, abusive or prohibited material;
  • cannot reasonably be reproduced;
  • is technically unsuitable;
  • creates a safety concern; or
  • otherwise breaches these Terms.

If we cancel an order for one of these reasons before production, we will refund any amount paid for the cancelled item, except where we are legally entitled to recover reasonable costs already incurred.


SECTION 4 – IMAGE QUALITY AND CUSTOMISATION DETAILS

The quality of a personalised product depends partly on the quality of the photograph or file provided.

For the best result, photographs should generally be:

  • clear and in focus;
  • well lit;
  • high resolution;
  • free from heavy filters;
  • large enough for the selected product;
  • not screenshots of low-resolution images; and
  • unobstructed around the pet’s face or relevant subject.

We may contact you if we believe a photograph is unsuitable.

However, we are not required to identify every image-quality problem before production.

You are responsible for checking all information you submit, including:

  • names;
  • dates;
  • spelling;
  • telephone numbers;
  • messages;
  • delivery addresses;
  • product sizes;
  • colours;
  • quantities; and
  • other customisation choices.

We are not responsible for an error reproduced exactly from information supplied or approved by you, except to the extent that the error was caused or contributed to by Pawrello.

If Pawrello or a production provider makes an error that causes the product not to match the accepted order, we will provide an appropriate remedy in accordance with our Refund Policy and the Australian Consumer Law.


SECTION 5 – DESIGN PROOFS AND APPROVALS

Some personalised products may include a digital design proof before production. Other products may proceed directly to production, as stated on the product page or during ordering.

Where a proof is supplied, you are responsible for reviewing:

  • spelling;
  • names;
  • dates;
  • layout;
  • image selection;
  • cropping;
  • colours;
  • design instructions; and
  • other customisation details.

You must notify us promptly of any requested correction.

Once you approve a design proof, production may begin immediately.

After approval and production have begun, we may be unable to:

  • edit the design;
  • change a photograph;
  • change the product;
  • change the size or colour;
  • change personalisation;
  • change the delivery address; or
  • cancel the order.

Your approval confirms that you accept the design shown, subject to reasonable differences between a digital proof and the finished physical product.

Approval does not remove any rights you may have under the Australian Consumer Law if the finished product is faulty, materially different from the approved design or otherwise fails to meet an applicable consumer guarantee.

A delay in approving a proof may delay production and delivery.

If we cannot obtain your approval after making reasonable attempts to contact you, we may place the order on hold until we receive instructions.


SECTION 6 – PRINT-ON-DEMAND PRODUCTION

Pawrello uses independent print-on-demand, printing, engraving, manufacturing and fulfilment providers.

To produce and deliver your order, we may provide these partners with relevant information, including:

  • Customer Content;
  • artwork and production files;
  • personalisation details;
  • product selections;
  • order reference numbers;
  • recipient names;
  • delivery addresses;
  • telephone numbers; and
  • email addresses where reasonably required for delivery.

Production providers may:

  • prepare artwork;
  • process images;
  • print or engrave products;
  • manufacture products;
  • perform quality checks;
  • package orders;
  • arrange delivery;
  • investigate production issues; and
  • produce replacements or reprints.

Production may take place inside or outside Australia.

Production and fulfilment providers operate their own facilities and systems and may use subcontractors where permitted by their arrangements with us.

The handling of personal information and Customer Content is also governed by our Privacy Policy.


SECTION 7 – ORDERS AND ACCEPTANCE

When you submit an order, you are making an offer to purchase the selected products under these Terms.

An automated order acknowledgement or payment authorisation does not necessarily mean that we have accepted the order.

An order is accepted when we:

  • expressly confirm acceptance;
  • begin preparing artwork;
  • begin production; or
  • dispatch the product,

whichever occurs first.

We may decline or cancel an order before acceptance where reasonably necessary, including where:

  • a product is unavailable;
  • a production provider cannot fulfil it;
  • payment is not authorised;
  • fraud is suspected;
  • Customer Content breaches these Terms;
  • there is an obvious pricing or product-description error;
  • delivery is unavailable to the supplied address; or
  • accepting the order would breach a legal requirement.

If we decline or cancel an order after payment, we will refund the applicable amount using the original payment method, except where another method is agreed or required.

We may contact you using the email address, telephone number or billing information supplied with the order.

Products purchased through Pawrello are intended for personal or household use unless we agree otherwise in writing.

You must not purchase products for unauthorised commercial resale or represent yourself as an authorised Pawrello reseller.


SECTION 8 – ORDER CHANGES AND CANCELLATIONS

You should review your order carefully before submitting it.

Because personalised products are made specifically for you, production may begin shortly after an order is accepted.

To request a change or cancellation, contact us as soon as possible at:

support@pawrello.com.au

We will make reasonable efforts to assist, but we cannot guarantee that an order can be changed or cancelled after:

  • artwork preparation has begun;
  • a design has been approved;
  • a production file has been created;
  • the order has been sent to a production provider; or
  • manufacturing or printing has begun.

If we can stop production, we may approve the cancellation or change.

Where work or production has already begun, we may deduct reasonable costs already incurred where permitted by law and clearly communicated to you.

This section does not limit your rights where a product is faulty, unsafe, incorrectly supplied or otherwise fails to comply with the Australian Consumer Law.


SECTION 9 – PRICES, GST AND PAYMENT

Unless otherwise stated, prices are displayed in Australian dollars.

Prices displayed to Australian consumers include any applicable GST where required.

Shipping charges and other applicable costs will be displayed before you complete checkout.

Prices, promotions and discounts may change without notice. A price change will not affect an order already accepted, except where there is an obvious pricing error and the law permits us to correct it.

If an obvious pricing error occurs, we may contact you before production and offer you the choice to:

  • proceed at the correct price; or
  • cancel the affected item and receive a refund.

Promotions may be subject to separate terms, including:

  • eligibility requirements;
  • minimum spending requirements;
  • product exclusions;
  • expiry dates;
  • usage limits; and
  • restrictions on combining promotions.

You agree to provide complete and accurate payment, billing and account information.

You confirm that:

  • you are authorised to use the selected payment method;
  • the payment information supplied is accurate; and
  • you will pay the total amount displayed and authorised at checkout.

Payment is processed by Shopify or the selected payment provider.

We generally do not receive or store your complete payment-card details.


SECTION 10 – SHIPPING AND DELIVERY

Production and delivery timeframes displayed on our website are estimates unless expressly stated otherwise.

Estimated delivery timeframes may include separate periods for:

  • artwork preparation;
  • proof approval;
  • production;
  • quality control;
  • dispatch; and
  • carrier delivery.

Delivery estimates may be affected by:

  • customer approval delays;
  • production demand;
  • stock availability;
  • carrier delays;
  • weather;
  • public holidays;
  • incorrect address details;
  • customs processing where relevant; and
  • events beyond our reasonable control.

We will not make false or misleading representations about delivery timeframes.

You are responsible for providing a complete and accurate delivery address.

Before dispatch, you must notify us promptly if an address needs to be corrected. We cannot guarantee that an address can be changed after an order enters production or fulfilment.

If an order is returned or must be reproduced because of an incorrect or incomplete address supplied by you, we may charge reasonable redelivery or reproduction costs where permitted by law.

This does not apply where the delivery problem was caused by Pawrello or our service provider.

If tracking shows that an order has been delivered but you cannot locate it, you should:

  • check the delivery location;
  • check with members of your household;
  • check with neighbours or building management where appropriate; and
  • contact us promptly.

We may ask the delivery provider to investigate.

We will provide any remedy required under the Australian Consumer Law where an order is not delivered within the required or agreed circumstances.

SECTION 11 – RETURNS, REFUNDS AND CONSUMER GUARANTEES

Returns, refunds, replacements and cancellations are also governed by our Refund Policy.

Because personalised products are made specifically for the customer, we generally do not accept change-of-mind returns after production has begun unless our Refund Policy expressly allows them.

However, this does not affect your rights under the Australian Consumer Law.

Products supplied to Australian consumers come with guarantees that cannot be excluded under the Australian Consumer Law.

Depending on the circumstances, you may be entitled to a:

  • repair;
  • replacement;
  • refund;
  • cancellation; or
  • compensation for reasonably foreseeable loss.

These rights may apply where a product:

  • is faulty;
  • is unsafe;
  • is not of acceptable quality;
  • is materially different from its description;
  • does not match an approved design;
  • is not fit for a disclosed purpose;
  • is incorrectly supplied; or
  • otherwise fails to meet an applicable consumer guarantee.

We will not require you to deal directly with the printing company or manufacturer where Pawrello is responsible for providing the remedy under Australian law.

We may reasonably request:

  • your order number;
  • a description of the problem;
  • photographs or video showing the issue; and
  • other information necessary to assess the claim.

Any requested evidence must be reasonably related to assessing the problem.

A customer is not entitled to a remedy for a problem caused solely by:

  • misuse;
  • accidental damage after delivery;
  • failure to follow care instructions;
  • normal wear and tear;
  • damage caused by a pet;
  • an incorrect selection made by the customer;
  • inaccurate customisation information supplied or approved by the customer; or
  • a low-quality photograph where the resulting limitation was reasonably apparent or disclosed.

This does not apply where Pawrello caused or contributed to the problem.

Nothing in these Terms imposes an arbitrary time limit on rights that may exist under the Australian Consumer Law.


SECTION 12 – PRODUCT CARE AND SAFE USE

You must follow any product-specific:

  • care instructions;
  • washing instructions;
  • fitting instructions;
  • age recommendations;
  • safety warnings; and
  • usage directions.

Unless expressly described as a pet toy, Pawrello products are not designed to be chewed, swallowed or used as toys.

Pet apparel, tags and accessories should:

  • be fitted correctly;
  • be checked regularly for wear or damage;
  • be removed if damaged;
  • be used under appropriate supervision; and
  • not be used where they create a choking, entanglement or injury risk.

Decorative products should be kept away from pets that may chew or ingest them.

You are responsible for assessing whether a product is appropriate for your pet’s size, behaviour and circumstances.

Nothing in this section excludes Pawrello’s obligations regarding product safety or consumer guarantees.


SECTION 13 – INTELLECTUAL PROPERTY

Except for Customer Content, the website and its materials are owned by or licensed to Pawrello, Shopify or the relevant rights holder.

Protected materials may include:

  • trademarks;
  • logos;
  • business names;
  • product names;
  • website text;
  • artwork;
  • product designs;
  • photographs;
  • graphics;
  • videos;
  • audio;
  • software;
  • page layouts; and
  • website functionality.

You may access and use our website for personal, lawful and non-commercial shopping purposes.

Without prior written permission, you must not:

  • reproduce;
  • copy;
  • republish;
  • modify;
  • distribute;
  • sell;
  • commercially exploit;
  • scrape;
  • download in bulk;
  • create derivative works from;
  • publicly display; or
  • publicly perform

any protected material from our website.

No provision of these Terms transfers ownership of Pawrello, Shopify or third-party intellectual property to you.

“Pawrello” and associated names, logos, graphics and slogans may be trademarks or other protected branding and must not be used without permission.

Shopify’s name, trademarks and branding belong to Shopify or its licensors.


SECTION 14 – OPTIONAL AND THIRD-PARTY TOOLS

We may provide access to tools or features supplied by third parties.

These may include:

  • product-personalisation tools;
  • image-upload tools;
  • product-review tools;
  • payment services;
  • delivery tracking;
  • social-media integrations; and
  • communication tools.

Third-party tools may be subject to their own terms and privacy policies.

We do not control every aspect of independent third-party tools.

Your use of an optional tool is at your discretion and subject to applicable law.

We may introduce new features, tools or resources. Unless stated otherwise, these will form part of the Services and will be subject to these Terms.


SECTION 15 – THIRD-PARTY LINKS

Our website may contain links to websites or services operated by third parties.

We do not control independently operated third-party websites and are not responsible for their:

  • content;
  • availability;
  • accuracy;
  • security;
  • privacy practices; or
  • terms.

You should review the relevant third party’s policies before purchasing, submitting information or using its services.

Nothing in this section limits liability that cannot legally be excluded.


SECTION 16 – RELATIONSHIP WITH SHOPIFY

Pawrello is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Pawrello.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Pawrello, including any injury, damage or loss resulting from purchased products and services.

You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Pawrello.


SECTION 17 – PRIVACY

Our collection, use, storage and disclosure of personal information are governed by our Privacy Policy.

Because our store is hosted by Shopify, Shopify may collect and process information relating to your access to and use of our website.

Information may also be shared with print-on-demand providers, printing companies, fulfilment providers, payment providers and delivery providers where reasonably necessary to process, produce and deliver an order.

Some providers may process information outside Australia.

By using our website, you acknowledge that you have had an opportunity to read our Privacy Policy.


SECTION 18 – REVIEWS, FEEDBACK AND PUBLIC SUBMISSIONS

You may choose to submit:

  • product reviews;
  • ratings;
  • testimonials;
  • comments;
  • suggestions;
  • ideas;
  • photographs intended for public display; or
  • other feedback.

This section applies only to content submitted for review, publication, promotion or public display. It does not apply to photographs privately uploaded only to fulfil an order.

By submitting content for public display, you grant Pawrello a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit, publish, display and distribute that content for:

  • operating our website;
  • displaying reviews;
  • promoting Pawrello;
  • social-media content;
  • advertising; and
  • improving our products and services.

Where practical, we may identify you using the name or username supplied with the review.

You confirm that:

  • you own or are authorised to submit the content;
  • the content is truthful and reflects your genuine experience;
  • you have disclosed any payment, gift or incentive associated with the review;
  • the content does not infringe another person’s rights;
  • the content is not defamatory, abusive, unlawful or misleading; and
  • any person shown has consented to the intended public use.

We may moderate, decline or remove content that breaches these Terms or applicable law.

We are not required to publish, maintain or respond to every submission.


SECTION 19 – ERRORS AND AVAILABILITY

Occasionally, our website may contain:

  • typographical errors;
  • outdated information;
  • incorrect product details;
  • pricing errors;
  • inaccurate delivery estimates; or
  • availability errors.

We may correct inaccurate information and update the website.

If an error materially affects an order, we will notify you and provide an appropriate option, which may include:

  • confirming the corrected information;
  • choosing an alternative product; or
  • cancelling the affected item for a refund.

We will not use this section to remove rights relating to an order already accepted where doing so would be unlawful or unfair.


SECTION 20 – PROHIBITED USES

You may use our website only for lawful purposes.

You must not use the website to:

  • break any applicable law;
  • infringe intellectual property or privacy rights;
  • upload content you are not authorised to use;
  • harass, threaten, abuse or defame another person;
  • submit false or misleading information;
  • impersonate another person or business;
  • commit or attempt fraud;
  • distribute spam or unauthorised advertising;
  • upload viruses or malicious code;
  • interfere with website security or operation;
  • collect another person’s information without authority;
  • gain unauthorised access to accounts or systems;

  • use Pawrello branding or content without permission.

Automated agents, bots or similar tools must not conceal their automated nature, bypass security measures or access the website after being instructed not to do so.

We may suspend or terminate access where we reasonably believe these Terms have been breached.


SECTION 21 – TERMINATION

You may stop using our website at any time.

We may suspend or terminate access to our website where reasonably necessary because of:

  • a material breach of these Terms;
  • unlawful activity;
  • fraud;
  • security risks;
  • misuse of the website;
  • non-payment; or
  • conduct that threatens Pawrello, Shopify, our providers or other customers.

Termination does not affect:

  • an accepted order unless separately cancelled;
  • amounts already owing;
  • rights or obligations accrued before termination; or
  • provisions intended to continue after termination.

Sections concerning intellectual property, Customer Content, privacy, liability, indemnity, governing law and other provisions that logically survive will continue after termination.


SECTION 22 – AUSTRALIAN CONSUMER LAW AND WARRANTIES

Our website and products are provided subject to all guarantees, warranties, rights and remedies that cannot lawfully be excluded.

Nothing in these Terms excludes, restricts or modifies:

  • the Australian Consumer Law;
  • statutory consumer guarantees;
  • liability for misleading or deceptive conduct;
  • product-safety obligations; or
  • any other right or remedy that cannot legally be excluded.

Except for rights that cannot be excluded, we do not guarantee that:

  • the website will always be available;
  • website access will be uninterrupted;
  • every website feature will be error-free;
  • every product will remain available; or
  • content submitted by third parties will be accurate.

We may temporarily suspend website access for maintenance, security, upgrades or circumstances beyond our reasonable control.


SECTION 23 – LIMITATION OF LIABILITY

Nothing in this section excludes, restricts or modifies liability or consumer rights where doing so would be unlawful.

To the extent permitted by law, Pawrello is not liable for loss caused solely by:

  • inaccurate information supplied by you;
  • customisation details approved by you;
  • unauthorised Customer Content supplied by you;
  • failure to follow product-care or safety instructions;
  • misuse or alteration of a product;
  • ordinary wear and tear;
  • damage caused by a pet after delivery;
  • an incorrect delivery address supplied by you; or
  • unauthorised access resulting from your failure to protect account credentials.

To the extent permitted by law, Pawrello is not liable for indirect or consequential loss that was not reasonably foreseeable when the contract was formed.

This limitation does not apply to the extent that loss was caused by:

  • Pawrello’s breach of an applicable consumer guarantee;
  • Pawrello’s negligence where liability cannot be excluded;
  • fraud;
  • wilful misconduct;
  • an unsafe product;
  • a breach of law; or
  • any matter for which liability cannot legally be excluded or limited.

Where liability can lawfully be limited, it will be limited only to the extent reasonable and permitted by law.


SECTION 24 – INDEMNITY

To the extent permitted by law, you agree to indemnify Pawrello against a third-party claim to the extent that the claim results from:

  • Customer Content supplied by you infringing another person’s rights;
  • your unlawful use of the website;
  • your material breach of these Terms; or
  • your fraud or wilful misconduct.

Your responsibility under this section is reduced to the extent that Pawrello or another person caused or contributed to the loss.

This section does not require you to indemnify Pawrello for its own negligence, unlawful conduct or breach of consumer guarantees.

We will notify you of a relevant claim within a reasonable period and provide reasonable information relating to it.


SECTION 25 – EVENTS OUTSIDE OUR REASONABLE CONTROL

We are not responsible for a delay or failure caused by an event outside our reasonable control, to the extent permitted by law.

These events may include:

  • natural disasters;
  • severe weather;
  • fire;
  • flood;
  • war;
  • civil unrest;
  • government action;
  • industrial disputes;
  • widespread carrier disruption;
  • telecommunications outages;
  • cyberattacks;
  • production-facility closures;
  • public-health emergencies; or
  • major supply-chain interruptions.

We will take reasonable steps to reduce the effect of the event and resume performance.

If we cannot supply an accepted order within a reasonable period, we will provide an appropriate remedy, including a refund where required by law.


SECTION 26 – SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be read down to the extent necessary.

If it cannot be read down, the affected part will be severed.

The remaining provisions will continue in effect.


SECTION 27 – WAIVER AND ENTIRE AGREEMENT

A failure or delay by Pawrello to exercise a right does not waive that right.

These Terms, together with our:
